1.1 Beach Retreats Holidays Ltd is a limited company (registered in England with company number 10780249) whose registered address is Watergate Bay, Newquay, Cornwall TR8 4AA.

1.2 Beach Retreats do not hold any proprietary interest in the properties but merely act as agents for the owners of the property (“the Owner”). The letting arrangements are made by Beach Retreats on behalf of the Owner and the contractual relationship in connection with the lettings is between the Owner and you.

2 Making a booking

2.1 Bookings may be made by telephone on 01637 861005 or via the Beach Retreats website at beachretreats.co.uk. Office hours are 09:00-18:00 Monday to Friday and 09:00-17:00 on Saturday. The office is closed on Sundays.

2.2 Beach Retreats may request details of all persons in your party including names and ages. If requested, this information must be provided in writing within fourteen days and prior to the first day of letting. This information may be required by the Owner or Appointed Agent for insurance purposes.

2.3 The booking is complete when you receive confirmation from Beach Retreats via email (“Booking Confirmation”) and in our capacity as agent for the Owner, this acts as acceptance of your offer to enter into a contract with the Owner in accordance with the terms of this contract. Beach Retreats will provide you with contact details for the Owner on request or any third party agent providing a service at the property on behalf of the Owner (“Appointed Agent”) and will pass your contact details to the Owner or its Appointed Agent when the booking is complete.

2.4 Hen or stag parties are not permitted in any of the properties unless agreed with the Owner or its Appointed Agent prior to booking.

2.5 We recommend that with every booking an appropriate travel insurance is taken out to include all members of the travelling party. It is your responsibility to check that your insurance cover is adequate.

3 Deposit

3.1 A booking, whether by telephone or via the Beach Retreats website, must be accompanied by a deposit.

3.2 If a booking is made eight weeks or more before the letting is due to start you must pay a deposit (“Deposit”) equal to the sum of one third of the fee for the letting of the property as set out on the Beach Retreats website (Letting Fee) plus a £55.00 non-refundable booking fee (“Booking Fee”).

3.3 If a booking is made less than eight weeks before the first day of the letting, the full letting fee, plus the non-refundable Booking Fee, plus any cautionary deposit (“the Cautionary Deposit”), if required by the Owner or Appointed Agent, plus any additional charges which will be made available to you via email or telephone on request, must be paid by you at the time of booking. The Cautionary Deposit varies for each property and can be located on the individual property listing description on Beach Retreats’ website.

3.4 We may from time to time, and at our sole discretion, offer a “Low Deposit” promotion. Details of the Low Deposit promotion (where available) will be indicated on the Beach Retreats website or you will be advised when making a booking by telephone (unless stated otherwise, this will usually apply in respect of bookings made a minimum of 7 calendar months before the date of letting). If a Low Deposit is available at the time of booking, you may be eligible to pay a non-refundable deposit of £150 (inclusive of the Booking Fee). The remainder of the Deposit (as defined in Clause 3.2) will be payable six months before the first day of the letting and the balance of the Letting Fee will be payable by the Due Date as defined in Clause 4.1.

4 Final Payment

4.1 Payment of the balance of the Letting Fee, plus any Cautionary Deposit, plus any additional charges due to Beach Retreats must be paid to Beach Retreats eight weeks before the letting is due to start (“the Due Date”).

4.2 Non-payment by the Due Date may be treated as a cancellation.

4.3 Beach Retreats does not and shall not be responsible for sending reminders of the Due Date.

5 Changing Booking Dates

5.1 Once a booking has been accepted and confirmed by Beach Retreats the booking can only be changed with the written agreement of the Owner and Beach Retreats.

5.2 Where a change to the dates of the letting is agreed, an administration fee of £30.00 must be paid by you.

5.3 Reinstating a cancelled booking will also incur a £30.00 administration fee.

6 Cancellation

6.1 If you wish to cancel the letting you must notify Beach Retreats in writing (“Cancellation Notice”) before the letting start date by post or email.

6.2 A booking can only be cancelled prior to the start of the letting.

6.4 In the event that a cancellation is made, a charge will be payable depending on the number of days before the letting start date that the notice is received by Beach Retreats. Notice to Beach Retreats must be given to by post or email. The amount payable is set out in the table below. All bookings require a non-refundable Booking Fee. Charitable donations made at the point of payment are also non-refundable.

7 Duration and Times of Letting

7.1 Lettings are for a maximum of 21 days and commence at 4.30 pm on the first day of the letting and end at 10.00 am on the day of departure unless otherwise notified.

7.2 The letting period booked cannot be exceeded unless Beach Retreats give prior written approval. You will be liable for any cost of whatever nature incurred because of an unauthorised extension. If you wish to have a late departure, or extend your stay, please speak to the Beach Retreats reservations team no less than 48 hours before the due departure date and time. Late departures and extensions are subject to availability.

8 Your Obligations

8.1 You (and all members of your party) agree:
(a) where a telephone is available for use at the property, to pay for all telephone charges incurred during a letting unless included in the letting fee;
(b) to vacate the property by 10am on the day of departure;
(c) to pay for any losses or damages to the property or its contents, caused by you or a member of your party (reasonable wear and tear excluded, which for the avoidance of doubt means repairs that are decorative and wear out or come adrift in the course of reasonable use) which will be determined at the Owner’s or its Appointed Agents’ discretion. Payment will be made to Beach Retreats (on behalf of the Owner);
(d) to report any damage, missing items or faults in the property to the Owner or its Appointed Agent within 24 hours of arrival. If no missing items, damage or faults are reported within this period, the property and its contents will be deemed to be in full working order;
(e) to take good care of the property and leave it in a clean and tidy condition at the end of the letting. A cleaning service is not provided during the letting unless otherwise specified or agreed. The Owner (or its Appointed Agent) may make an additional, reasonable charge for professional cleaning after your occupancy as may be required to return the Property to its original state of cleanliness and tidiness. Should the Owner or Appointed Agent be dissatisfied with the condition of the property upon your departure, they may refuse to take a booking from you again. If you are excluded from a property then Beach Retreats have the right to refuse any more bookings from you at any property;
(f) to permit the Owner or Appointed Agent and Beach Retreats reasonable access to the property;
(g) not to part with possession of the property, or share it, except with members of the party confirmed in the booking;
(h) not to sell or transfer the booking to another party without the written agreement of the Owner or Appointed Agent;
(i) not to exceed either the total number of people stipulated in the property description or the total number of people stated in the Booking Confirmation;
(j) to get advanced written consent, through Beach Retreats, from the Owner, for any visitors to the property;
(k) to not hold events (such as parties, celebrations or meetings) at the accommodation without written consent from the Owner;
(l) not to use the accommodation for any illegal or commercial purpose;
(m) to respect the well-being of those occupants of adjoining or nearby properties and not to cause an annoyance or become a nuisance. Complaints from adjoining or nearby occupants to Beach Retreats properties regarding your behaviour may result in the Owner or Appointed Agent or Beach Retreats requiring you to leave the property immediately without a refund of any monies paid by you.
(n) to ensure that you secure the property (including all windows and doors) whenever leaving the Property.
(o) to refrain from smoking, vaping and the use of illegal drug use at the Property or in the grounds. Where it is apparent that you or a member of your party has smoked, vaped or taken illegal drugs at the property, you may be charged for any additional costs incurred including costs for cleaning the property and including liability for the cost of cancelling all or part of any subsequent bookings if the property has been rendered uninhabitable. We reserve the right to ask any guest found breaching this Clause to leave the property immediately and no refunds will be provided for your stay ending early.
(p) not to use candles or fireworks in or at the property.
(q) to comply with all rules and guidance at the property including information relating to appliances and equipment.

9 The Cautionary Deposit

9.1 Where a Cautionary Deposit is required, this will be stated at the end of the property description as displayed on the website and in the brochure and confirmed in the Booking Confirmation. The Cautionary Deposit is non-interest bearing.

9.2 The Owner or Appointed Agent shall be entitled to deduct from the Cautionary Deposit the cost (including but not limited to reasonable costs for breakages, damage and any other incidental costs where applicable) of remedying any breach of your obligations pursuant to this agreement and shall be entitled to charge any additional amount where the Cautionary Deposit does not fully cover the cost of remedy.

9.3 The Cautionary Deposit is accepted by Beach Retreats as agent for the Owner.

9.4 All disputes are the responsibility of the Owner or Appointed Agent and will be dealt with directly between you and the Owner or its Appointed Agent. Beach Retreats cannot act on your behalf in any dispute between the Owner or Appointed Agent and yourself concerning it.

9.5 Where no breach of obligations pursuant to this agreement has occurred, you will be refunded the whole amount of the Cautionary Deposit within 7-10 days of the end of the letting period. Where deductions to the Cautionary Deposit are made pursuant to Clause 9.2 the balance will be paid as soon as practicable after Beach Retreats has received quotes for replacement or remedial works.

10 Non-availability of Property

10.1 If for any reason beyond Beach Retreats’ or the Owner’s or the Appointed Agents’ reasonable control the property is not available on the date booked, or the property becomes unsuitable for holiday letting, Beach Retreats may cancel the booking and all Letting Fees and charges paid in advance by you will be refunded in full by Beach Retreats on behalf of the Owner within 3-5 working days.

10.2 Where possible Beach Retreats will provide you with four weeks’ notice except in extraordinary circumstances.

10.3 If the notice period is less than four weeks Beach Retreats will endeavour to find you alternative accommodation or, at your request, refund to you any sums you have paid. If alternative accommodation is provided, a new booking confirmation will be sent to you. You will have no further claim against Beach Retreats, the Owner and / or the Appointed Agent.

10.4 In the event you should choose alternative accommodation (pursuant to Clause 10.3) which is more expensive than the original booking, you will be required to pay the difference.

11 Price and Property Changes

11.1 Information relating to the property has been provided by the Owner. Beach Retreats does not warrant the accuracy or completeness of such information.

11.2 Beach Retreats cannot accept responsibility for errors contained in the information or any mis-description as a result of inaccurate information given to us by the Owner or Appointed Agent.

11.3 Beach Retreats and the Owner do not accept responsibility for any disruption building or road works, or events near the property nor any impact such works may have on your stay. If the Owner or Beach Retreats are made aware of any nearby building or road works, or events which may impact the booking, affected guests will be notified as soon as practicable via telephone or email.

11.4 You acknowledge that minor differences may arise between that information given and the actual property itself. Images of the property may not always be as represented on Beach Retreats’ website.

11.5 Beach Retreats reserves the right to amend prices quoted in published information and via the Beach Retreats website due to errors or omissions or changes in the VAT rate. Any such changes shall be notified to you as soon as possible.

11.6 You shall be at liberty to cancel the booking if the amended price (as described in Clause 11.5) is significantly higher than the original price advertised (or quoted where no deposit has been taken).

11.7 Subject to Clause 11.5, any changes in the rate of VAT payable on applicable lettings will be borne by you. VAT on lettings is dependent on the VAT status of the property.

11.8 Clauses 11.1 – 11.6 inclusive are particularly pertinent in respect of any properties which are advertised on the Beach Retreats’ website but are currently being built.

12 Liability – Beach Retreats

12.1 If Beach Retreats fails to comply with the terms of this contract, it is responsible for loss or damage you suffer that is a foreseeable result of Beach Retreats’ breach of this contract or negligence, but Beach Retreats is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if this is contemplated by you and Beach Retreats at the time this contract was entered into. Beach Retreats responsibilities to you are limited to making the booking in accordance with your instructions. For the avoidance of doubt, Beach Retreats is not liable for any transport and/or alternative stay costs and or any loss of or damage to your possessions or vehicles on the Owner’s property howsoever caused. As Beach Retreats acts as agent for the Owner, it accepts no liability for any acts or omissions of the Owner or the Appointed Agent, including any shortcomings or defects with the property. Subject to Clause 12.2, Beach Retreats total liability to you will not exceed the Letting Fee in respect of your letting of the property.

12.2 Beach Retreats does not limit its liability for;

12.2.1 death or personal injury caused by Beach Retreats’ negligence or the negligence of its employees, agents or subcontractors;

12.2.2 fraud or fraudulent misrepresentation; or

12.2.3 any liability it would be unlawful to exclude.

13 Liability – the Owner

13.1 The Owner provides the property for holiday use only. You agree not to use the property for any commercial, business or resale purpose, and the Owner has no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

13.2 If the Owner fails to comply with this contract, they are responsible for loss or damage that you suffer that is a foreseeable result of their breach of this contract or their negligence, but the Owner is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of the Owner’s breach or if it was contemplated by you and the Owner at the time this contract was entered into. For the avoidance of doubt, the Owner is not responsible for any transport and/or alternative stay costs. Subject to Clause 13.3, the Owner’s total liability to you will not exceed the Letting Fee in respect of the property.

13.3 The Owner does not limit its liability to you for;

13.3.1 death or personal injury caused by negligence;

13.3.2 fraud or fraudulent misrepresentation; or

13.3.3 any liability it would be unlawful to exclude.

13.4 The Owner does not have any responsibility or liability to you (other than as outlined above) for loss of or damage to any of your items, belongings or vehicles, howsoever caused.

14 Pets

14.1 Pets are only permitted with the prior consent of Beach Retreats or the Owners or the Appointed Agent and where such pets are permitted, they are to be well-behaved, kept under control and exercised off the premises.

14.2 Pets are not permitted in the bedrooms or on the furniture and neither Beach Retreats nor the Owners not the Appointed Agent can accept responsibility for their safety. Dogs must not be left unattended in the property or in a vehicle outside of the property at any time.

14.3 A charge will be made for pets in the sum of £45 per pet per stay, which is payable to Beach Retreats as agents for the Owner at the time of booking. Guide or hearing dogs are permitted to stay at no extra charge.

14.4 It is your responsibility to ensure your pets do not disturb those in adjoining properties or nearby and, on departing from the property, it is your responsibility to ensure that you have cleared up after your pets and that there is no trace of your pets having been at the property. If any additional cleaning is required that may incur an additional charge will be payable by you at the discretion of Beach Retreats, the Owner or Appointed Agent. Any damage caused by pets must be reported to Beach Retreats, the Owner or Appointed Agent immediately.

14.5 Beach Retreats reserves the right to deduct £40 from the Cautionary Deposit in the event of dog mess having to be cleared after departure.

14.6 Where the description of a property states ‘regret no pets’ or otherwise restricts the keeping of pets at the property, Beach Retreats and/or the Owners/Appointed Agent cannot guarantee that there has been no pets previously kept at the property.

14.7 Pet owners must ensure that their pets are free from all parasites and fleas before they occupy the property. Failure to do so may incur additional charges.

14.8 If you or your guests have an allergy to animals, please be aware that Beach Retreats cannot guarantee that an assistance dog, or other animals, have not stayed in a particular property. Beach Retreats cannot accept responsibility for any health condition which may occur as a result of any animals having been present in a property.

14.9 You must be mindful of other people and animals, including livestock, in the vicinity so as not to allow your pet to become a nuisance.

14.10 You should provide pet bedding and necessary equipment, including food, water bowls and towels.

15 Hot tubs, swimming pools and saunas

15.1 If the property has a hot tub, swimming pool or sauna it will be clearly stated in the property description. For your safety and enjoyment there are strict rules and guidance that must be adhered to when using a hot tub, swimming pool and sauna.

15.2 Where hot tubs are provided at the property, you agree that you and all members of your party will:

15.2.1 follow the safety guidance at the property

15.2.1 shower with soap and water before use

15.2.3 enter and exit the hot tub slowly and with care

15.2.4 not jump or dive into the hot tub

15.2.5 not bring any glassware near or into the hot tub

15.2.6 ensure that elderly persons, pregnant women and guests with heart disease, diabetes, high or low blood pressure or any other serious illness will consult with a doctor before entering the hot tub

15.2.7 not use alcohol, narcotics or medication before or during use of the hot tub

15.2.8 not allow children between the age of 0-5 to use the hot tub

15.2.9 ensure that children will be supervised by an adult at all times

15.2.10 tie up or wear a cap if you have long hair

15.2.11 limit your soak to 15 minutes and ensure you cool off before re-entering

15.2.12 not use soaps or essential oils in the hot tub

15.2.13 check the temperature of the hot tub before use and will not enter if the water temperature is over 40 Celsius

15.2.14 turn off high jets and replace the hot tub cover after each use

15.2.15 not sit or lie on the hot tub cover

15.2.16 NEVER tamper with the mains switch of the hot tub (even when not in use) nor attempt to open the electrical box.

15.2.17 keep all loose articles of clothing, jewellery and hair away from jets and moving components.

15.3 Failure to observe such rules may result in the hot tub being deemed closed for the rest of the duration of your letting. Should the amenities be closed during your stay, due to you being in breach of any of this Clause 15, you will have no right to compensation.

15.4 For health and safety reasons a hot tub may be required to be emptied and refilled between guest bookings. If a property has a departure and arrival on the same day it may mean that the hot tub may not reach temperature until the following morning.

15.5 Where access to a swimming pool is provided, you agree that you and all members of your party will:

15.5.1 follow the safety guidance at the property

15.5.2 shower with soap and water before use

15.5.3 enter and exit the pool via the steps and with care

15.5.4 not jump or dive into the pool

15.5.5 not run, shout, dive bomb or push in and around the pool

15.5.6 ensure that children are supervised by an adult at all times

15.5.7 not play ball games in and around the pool

15.5.8 not bring any food or glassware poolside

15.5.9 not use alcohol, narcotics or medication before or whilst using the pool

15.5.10 wear suitable swim attire

15.5.11 not wear outdoor footwear poolside

15.6 Where access to a sauna is provided, you and all members of your party will:

15.6.1 follow all sauna safety guidance at the property

15.6.2 not allow children under the age of 16 in the sauna unsupervised (unless it is an infrared sauna)

15.6.3 food or glassware is not permitted in or around the sauna

15.6.4 not use alcohol, narcotics or medication before, during and after use of the sauna

15.6.5 always use a towel to sit on

15.6.7 follow instructions of use when switching the sauna on and off

15.6.8 limit your time to 15-20 minutes per sitting and leave the sauna once you feel hot.

16 Amenities

16.1 Please refer to the Property listing on the Beach Retreats website for the terms for charging an electric vehicle as this varies for each property. It is your responsibility to check suitability and whether the provision is included in the price, or as an additional charge.

16.2 Where a vehicle is charged without prior authorisation the full costs of an advertised rate will be incurred per day plus an administration fee.

16.3 If you are keeping an electric vehicle at the property, you must use designated charging points (where available) and manufacturer approved cables for charging any vehicles at the property. The use of the domestic supply for EV charging is strictly prohibited.

16.4 Please note the Owner or Beach Retreats cannot guarantee access to EV charging where it is available through a communal charging point.

16.5 Beach Retreats will endeavour to advertise on the individual property listing those properties that have ring cameras (or equivalent) or CCTV for security purposes. Beach Retreats cannot be held responsible for missing or inaccurate information supplied by the Owner.

16.6 It is your responsibility to ensure that any use of a personal television account such as, but not limited to Netflix, YouTube, Amazon Prime, Disney+ or Apple TV on a property smart television or other device in the property has been properly signed out before you leave. Beach Retreats cannot be held liable for any use of these accounts by another party/guest.

16.7 Tablets in the property are provided to help connect all our guests with local amenities and third party local suppliers. Please ensure they are returned to their stand and charged after each use. Tablets are an electronic version of Beach Retreats’ guest directory and house guidebook and cannot be used to access the internet or apps. An admin charge of £30 is applicable if they are removed from the property.

16.8 Where broadband internet is provided, there is no guarantee of a minimum speed, unrestricted bandwidth, or uninterrupted provision. Beach Retreats and the Owner are not liable for any failure or interruption to the broadband access.

17 Lost Property

17.1 At the end of every stay, please ensure you check that all personal items have been packed. The Owner or their Appointed Agent will store lost property items for a maximum of one month after which they will be given to charity or disposed of. Items can be posted to the guest for the cost of the postage plus an admin fee.

18 Method of Payment

18.1 Payments may be made by cheque (drawn from a UK bank only), credit card, or debit card.

18.2 Cheques should be made payable to ‘Beach Retreats’.

18.3 Post-dated cheques are not acceptable

18.4 Any charges raised against Beach Retreats by its bank for handling dishonoured cheques, bank transfers or any other payments will be passed on to you and you are liable to reimburse Beach Retreats within seven days of receipt of notification from Beach Retreats. All payments by debit and credit card will not attract a surcharge. In accordance with Clause 3.2 a Booking Fee is applied to all bookings.

19 Overseas Bookings

19.1 Overseas applicants may pay by Sterling cheque drawn on a UK bank or by Mastercard or Visa in Sterling. Any charges for payments from overseas will be passed on to you.

19.2 You will be responsible for ensuring that you, all persons in your party and any pets have the relevant travel and health documents and requirements needed for visiting the Property. These include any passport or other identification documents, visa requirements and, in the case of pets, any vaccines or microchips. We will not be liable for any expenses incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with such requirements

20 Eligibility

20.1 Beach Retreats on behalf of the Owner reserves the right to accept or refuse bookings at its absolute discretion.

21 The Holiday Letting

21.1 The letting confers upon you the right only to occupy for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.

22 Information published

22.1 Some information published by Beach Retreats relates to matters beyond the properties such as shops and public houses. Closure of such premises and other changes to external facilities are outside Beach Retreats’ control. If Beach Retreats is aware of any changes to the information at the time of your booking, then it shall endeavour to inform you of these changes.

23 Complaints

23.1 All complaints must be notified to the Owner or Appointed Agent as soon as reasonably practicable, as the Owner or Appointed Agent may be required to carry out on-the-spot investigation and if necessary, carry out remedial action. Contact details for the Owner or Appointed Agent will be provided to you in your confirmation email and at the property.

23.2 If the complaint is not resolved by the Owner or Appointed Agent then the complaint must be notified to Beach Retreats who will attempt to resolve the problem. Beach Retreats may carry out on-the spot investigation.

23.3 If Beach Retreats or the Owners or the Appointed Agent are denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the letting, then this may result in a reasonable reduction of any compensation payable to you arising out of such a complaint.

24 Linen

24.1 The property is equipped with bed linen (duvets, sheets, pillowcases), bath and hand towels, oven mitts, tea towels and bath mats (one per bathroom). Clean bed linen will be provided on the letting start date. No change of bed linen will be provided except during stays of 10 days or more where a change of bed linen and towels will be provided.

24.2 If additional linen or towels are required they can be requested, for an additional charge, from the housekeeper. Charges vary for each property.

25 VAT

25.1 Subject to Clause 11 the price quoted will be the price inclusive of VAT where payable

26 Breach of Contract

26.1 If there shall be a material breach of any of these conditions by you, the Owners, or the Appointed Agent, Beach Retreats reserve the right to re-enter the property and terminate the letting. In the event that Beach Retreats is unable to find someone else to occupy the property for the remainder of your stay, no refund of any sums you have paid will be returnable to you.

26.2 If there shall be a material breach of any of these conditions by Beach Retreats, the Owners or the Appointed Agent, then you have the right to terminate the letting. You will be entitled to recover the Letting Fee, Booking Fee and deposit in the event of such a breach where such breach is prior to your stay. Where a breach occurs during your stay, you will be entitled to recover the Letting Fee on a pro rata basis.

26.3 Termination of the letting pursuant to conditions 26.1 and 26.2 does not affect that party’s other rights and remedies.

27 Governing Law and Jurisdiction

27.1 This contract and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

27.2 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this contract or its subject matter or formation.

28 Authority to Accept

28.1 The person who completes the booking and therefore accepts the terms of this contract confirms that:
a) he or she is authorised to agree the booking conditions on behalf of all persons included on the booking, including those substituted or added at a later date;
b) he or she is over eighteen years of age and a member of the party intending to occupy the property; and
c) he or she agrees to take responsibility for the party occupying the property.

29 Discrepancies

29.1 In the event of inconsistency between these booking conditions and any other information regarding the property, these booking conditions will prevail.

30 Data and Privacy

30.1 In making a booking we will ask for personal information such as your name, postal address, email address, telephone number and payment details. From time to time we may use other companies and individuals for the purposes of administration. These companies and individuals will not be allowed to use your personal information for any other purpose than that which Beach Retreats may have instructed. Your identity will also be made available to the Owner and their Appointed Agent. By booking with us you are deemed to have consented to use of personal information for these purposes. If you require any more details concerning your personal details, please refer to our privacy policy.

30.2 Beach Retreats are committed to protecting your privacy. We will only use the information that we collect about you lawfully, in accordance with all applicable laws concerning the protection of personal data; including the Data Protection Act 1998 (DPA) and The General Data Protection Regulation 2016 (GDPR) together, and with other subsequent laws “Data Protection Laws”. Your information will be processed by Beach Retreats in accordance with our privacy policy. If you are not booking online a copy of our privacy policy will be available on request

31 Validity Clause

31.1 If any provision or part-provision of this contract is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this contract.

31.2 If any provision or part-provision of this agreement is deemed deleted under Clause 31.1 the parties shall negotiate in good faith to agree a replacement provision that, to the greatest extent possible, achieves the intended commercial result of the original provision.
