Agency booking terms for Seaspace

The following Agency Booking Conditions together with our Privacy Policy and, where your enquiry is made via the website, our website terms and conditions of use, together with the general information contained on our website and any other information we have brought to your attention on the telephone before we confirmed your booking with SeaSpace Porth Limited govern your booking made by Beach Retreats Holidays Limited a company registered in England and Wales with company number: 10780249 and registered office at On the Beach, Watergate Bay, Newquay, Cornwall, TR8 4AA (Beach Retreats).

Please Note: We act only as an agent in respect of all bookings we take and/or make on your behalf with SeaSpace Porth Limited, a company registered in England and Wales with company number: 04658829 and registered office at Watergate Bay Hotel, Watergate Bay, Newquay, Cornwall, TR8 4AA (SeaSpace).

We accept no liability in relation to any contract you enter into for your stay, or other any other services you purchase in respect of your stay with SeaSpace or for the acts or omissions of any supplier or third party connected with any such arrangements. For all bookings, your contract will be with SeaSpace.

These Agency Booking Conditions set out our respective rights and obligations so please read them carefully. By asking us to confirm your booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she/they:
– is / are over 18 and authorised to make the booking on behalf of all persons named on the booking and by the parent / guardian of any children under 18 years of age named on the booking. You will provide the names and ages of each member of the party if they are under 18;
– has / have read these Agency Booking Conditions and agree to be bound by them;
– consents / consent to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements);
– accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

In these Agency Booking Conditions “you” and “your” means all persons included in the booking (including anyone who is added or substituted at a later date).  “We”, “us” and “our” means Beach Retreats.

Making your booking

All enquiries are made through our website and all bookings are made via telephone. Secure payment is taken at the time of booking.

When making your booking we will arrange for you to enter into a contract with SeaSpace as agent. We accept no responsibility for the acts or omissions of SeaSpace or for any services provided by SeaSpace.
Your booking via us is subject to these Agency Booking Conditions and SeaSpace’s booking conditions and we advise you to read both carefully prior to booking. SeaSpace’s booking conditions may limit and/or exclude their liability to you.

We are entitled, on behalf of SeaSpace, to refuse any booking placed by you.

Prices & Payment

Accommodation prices are quoted in pound sterling. Please note that changes and errors occasionally occur. You must check the price of your chosen accommodation at the time of booking. We reserve the right to increase or decrease prices of unsold accommodation to correct errors at any time. If we accept a booking and there is an obvious pricing error that should have been recognised by you as an error, SeasSpace may terminate the contract and refund any sums which you have paid.

The price payable for the accommodation is as set out on our website (“Booking Price”). The Booking Price is inclusive of VAT.

If a booking is made eight weeks or more before your booking is due to start you must pay a deposit (“Deposit”) equal to the sum of one third of the Booking Price set out on the Beach Retreats website.

If a booking is made less than eight weeks before the first day of your booking, the full Booking Price, plus any cautionary deposit (“the Cautionary Deposit”), if required by SeaSpace, plus any additional charges which will be made available to you via email or telephone on request, must be paid by you at the time of booking. The Cautionary Deposit, if applicable, will be set out on the Beach Retreats’ website.

Payment of the balance of the Booking Price, plus any Cautionary Deposit, plus any additional charges due to Beach Retreats must be paid to Beach Retreats eight weeks before you booking is due to start (“the Due Date”).

Attempted bookings made without payment of the deposit, or where payment fails, will be cancelled and you will not receive a confirmation booking email.

Non-payment by the Due Date may be treated as a cancellation.

Beach Retreats does not and shall not be responsible for sending reminders of the Due Date.

All Credit Card card payments are processed by us, acting as booking agent on behalf of SeaSpace.
Except where SeaSpace tells you or their booking conditions state otherwise, all monies you pay to us in respect of the booking will be held by us as agent on behalf of SeaSpace and forwarded on to SeaSpace in accordance with our agreement with SeaSpace.

Damage Deposit

We may require a damage deposit as a precaution against any damage sustained to the accommodation during your stay. When you book through us, you accept responsibility for any damage or loss caused by you or any member of your party.

Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made as soon as possible if not deducted from the damage deposit or the deposit is insufficient to cover the damage or loss. If the actual cost of the loss or damage exceeds the damage deposit paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against SeaSpace and all costs incurred by it (including SeaSpace and the other party’s full legal costs) as a result of your actions.

Confirmation

Subject to the availability and receipt of payment, you will receive an email to the email address given at the time of booking, confirming your payment.

Your booking is confirmed and a contract between you and SeaSpace will exist when we send you confirmation of your booking.

The booking information that you provide to us will be passed on to SeaSpace, therefore please check that all names, dates and timings are correct on the booking confirmation, and any other document and advise us of any errors immediately. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

If you do not receive a booking confirmation within 24 hours of payment, please contact us immediately via email.

The booking information that you provide to us will be passed on only to SeaSpace or other third parties necessary for the provision of the services.

You will need to take your booking confirmation with you as you may need to present this upon arrival to gain access.

You are required to check in and out in accordance with SeaSpace’s booking conditions.

Additional requests

If you have any requests (for example dietary requirements), or if you would like to bring a dog, please let us know at the time of the booking. We will pass on all such requests to SeaSpace, but we can’t guarantee that they will be met and we will have no liability to you if they are not.

Please note that dogs are only permitted to stay with you in accordance with the SeaSpace booking conditions and an additional fee of £15 per night for the first dog and £5 per night for the second. These charges do not apply in respect of medical alert dogs or guide dogs.

The fact that a special request has been noted on your confirmation email or any other documentation or that it has been passed on to SeaSpace is not confirmation that the request will be met.

Babies and Children

SeaSpace will allocate accommodation to guests under 17 years so that they are sharing with a parent, guardian or supervising adult as applicable. Guests under 17 years will not be in a separate accommodation without adult supervision unless the apartments are interconnected.

Medical conditions

If you or any member of your party has any medical condition or disability which may affect your stay, please provide us with full details before we confirm your booking, including any special requirements such as a need for easy access accommodation and we will pass them on to SeaSpace.

Acting reasonably, if SeaSpace is unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking on SeaSpace’s behalf or, if you did not give us full details at the time of booking, we will inform SeaSpace who may cancel the booking or may impose applicable additional charges, when we become aware of these details.

Insurance, Car Parking and Electric Vehicles

We recommend that with every booking an appropriate travel insurance is taken out to include all members of the travelling party. It is your responsibility to check that your insurance cover is adequate.

SeaSpace’s arrangements for car parking are set out in the booking conditions and its policy for electric vehicle charging is available via the SeaSpace website.

Personal data

The booking information that you provide to us will be passed on only to SeaSpace or other third parties as necessary for your stay and your related arrangements. Please see our Privacy Policy for more information on your rights and how we process personal data.

Your personal information may be provided to public authorities as required by law.

Any special category (sensitive) information that you give to us such as details of any disabilities, dietary and / or religious requirements is provided with your explicit consent. In making your booking, you also consent to this information being passed on to the relevant third parties in relation to your booking.
Certain information may also be passed on to security or credit checking companies. If we cannot pass this information to SeaSpace we may be unable to provide your booking.

All personal data processed by SeaSpace will be processed under their own terms as a data controller in their own right. For more information on how SeaSpace will process your personal information please view their privacy notice.

Accuracy

We endeavour to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate, however, occasionally changes and errors occur, and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the stay that you wish to book before you make your booking.

All descriptions and content on our website or otherwise issued by us is done so on behalf of SeaSpace and are intended to present an overview of the services provided by SeaSpace. All services shown are subject to availability. If you require any further details, please contact us.

Behaviour

You (including all adults, children or dogs) are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others in accordance with SeaSpace’s booking conditions.
Please note that with the exception of baby foods, only food and drink that is purchase on the premises may be consumed at SeaSpace.

If in the opinion of SeaSpace or in the opinion of any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other guests or any third party, or damage to property, SeaSpace reserves the right to terminate your booking immediately with no further liability to you.

You are responsible for reporting any damage to the accommodation to SeaSpace immediately. You and/or your party may also be required to pay for loss and/or damage caused by your actions. Full payment for any such damage or losses must be paid directly to SeaSpace prior to departure.

Changes and cancellations by you

If you have to, or want to cancel or amend your booking, this request must be sent to us by email from the email address used to create the booking.

A booking can only be cancelled prior to the start of the letting.

We will respond within two working days of receipt. Please ensure that you have received written confirmation of any changes to your booking prior to travel.

Whilst we will always try to help, we cannot guarantee that any specific requests will be met. Any amendments and cancellations can only be accepted in accordance with the SeaSpace booking conditions and cancellation charges may be payable. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

SeaSpace may cancel the booking due to the unavailability of key personnel or key facilities without which SeaSpace cannot provide the accommodation, including in circumstances of an event outside its control. If this happens:

(a) SeaSpace will promptly contact you to let you know;

(b) SeaSpace may cancel the booking and refund your payments, or offer alternative accommodation and refund any payments for accommodation not yet provided to you less the cost of alternative accommodation;

(c) if SeaSpace offers alternative accommodation you may still choose to cancel the booking and SeaSpace will refund the payments you have made to us.

7.2 We may cancel the contract for accommodation at any time with immediate effect if:
(a) you do not pay us when you are supposed to, or

(b) you are in breach of the Agency Booking Conditions in any other material way and where the breach is capable of remedy by you, you do not remedy the situation within a reasonable period after we ask you to.

We will inform you as soon as reasonably possible if SeaSpace needs to make a significant change to your booking or to cancel it.

SeaSpace is entitled to cancel your booking at any time.

In the event that your accommodation arrangements cannot proceed because your accommodation is not available for any reason and SeaSpace is unable to provide a reasonable alternative, SeaSpace will refund the payments you have made to us for your booking. Should a reasonable or improved alternative be offered, a refund will not be applicable. SeaSpace will not be responsible for any other expenses including without limitation, the cost of flights or any other form of transport.

Except where otherwise expressly stated in these booking conditions, we cannot accept liability or pay any compensation or expenses where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. “force majeure” means any act or event beyond our reasonable control including but not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

SeaSpace may cancel your booking at any time with immediate effect if you do not arrive on the day in which your booking commences, or you have not notified us of a later arrival, SeaSpace will cancel the booking, and you will not be entitled to a refund.

Injuries & loss of possessions

As your contract is with SeaSpace and we act as agent only, we accept no responsibility should you or a member of your party suffer injury or loss of possessions (through theft or accidentally) whilst staying with SeaSpace.

Complaints

Should you have a problem or complaint about the booking service that we provide, you must raise this at the time with us, via email life@beachretreats.co.uk. This will enable most complaints to be handled in the shortest time possible. We are unable to respond to complaints about SeaSpace.

Should you have any queries or concerns about SeaSpace, and/or their services, this should be addressed to SeaSpace in accordance with their booking conditions. If you have a problem during your stay at SeaSpace, this must be reported to SeaSpace as soon as reasonably possible.

If you wish to complain when you return home, please contact SeaSpace, you will find their contact details in the confirmation that we send you or email hello@sea.space

If you remain unsatisfied, you can inform us, via email life@beachretreats.co.uk as soon as possible and, in any event, within 28 days of the date of your stay at SeaSpace whereby we will endeavour to assist in our capacity as an agent by liaising with SeaSpace on your behalf.

Our liability to you

Our only contractual obligation to you is to take your booking in accordance with your instructions and provide you with a confirmation email in respect of your stay with SeaSpace. As agent, we accept no responsibility for your stay, or any other services provided by SeaSpace. Our responsibilities are limited to making the booking in accordance with your instructions.

We accept no responsibility for any information about SeaSpace that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the value of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

Law and jurisdiction

These Agency Booking Conditions are governed by English law and are subject to the exclusive jurisdiction of the courts of England and Wales.
